By accessing or using the Kilimolink platform, you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access or use our services.

2. Description of Service

Kilimolink is a technology platform that connects farmers with commercial kitchens (restaurants, hotels, schools, hospitals, etc.) for the supply of fresh produce. Our services include:

  • AI-powered matching between farmers and buyers
  • Order management and processing
  • Refrigerated transportation and delivery
  • Payment processing and management
  • Quality assurance and customer support

3. User Accounts and Registration

Account Creation

To use our services, you must create an account by providing accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials.

Eligibility

  • Farmers: Must own or legally operate agricultural land
  • Businesses: Must be legally registered commercial entities
  • All users must be at least 18 years old
  • Must provide valid identification and business documentation

4. Farmer Terms

Produce Quality Standards

Farmers agree to:

  • Provide produce that meets our quality standards
  • Ensure products are fresh, safe, and properly handled
  • Comply with applicable agricultural and food safety regulations
  • Allow quality inspections at their farms
  • Provide accurate information about farming practices

Delivery and Pickup

  • Make produce available for pickup at agreed times
  • Properly package produce for transport
  • Notify us immediately of any supply issues
  • Maintain consistent supply as per agreements

5. Business Customer Terms

Orders and Payment

Business customers agree to:

  • Place orders accurately and in advance as required
  • Pay for orders according to agreed payment terms
  • Be available to receive deliveries at scheduled times
  • Inspect deliveries promptly and report issues within 2 hours
  • Provide safe and accessible delivery locations

Cancellations and Changes

  • Order cancellations must be made at least 12 hours before delivery
  • Changes to orders may incur additional fees
  • Last-minute cancellations may result in charges

6. Pricing and Payment

Pricing

Prices are determined through our AI-powered matching system based on market conditions, quality, and other factors. All prices are in Kenyan Shillings (KSh) unless otherwise specified.

Payment Terms

  • Farmers: Payment on time after delivery confirmation
  • Businesses: Payment due upon delivery or as per credit terms
  • Late payment fees may apply for overdue accounts
  • All payments are processed through secure, certified payment providers

7. Quality Assurance and Returns

Quality Guarantee

We guarantee the freshness and quality of all produce delivered. If you receive substandard produce:

  • Report issues within 2 hours of delivery
  • Provide photographic evidence if requested
  • We will investigate and provide replacement or refund

Delivery Guarantee

We guarantee 100% on-time delivery. If we fail to deliver on time, you may be eligible for service credits or refunds.

8. Prohibited Uses

You agree not to:

  • Use the platform for any illegal or unauthorized purpose
  • Violate any laws in your jurisdiction
  • Transmit harmful or malicious content
  • Interfere with or disrupt the platform's operation
  • Attempt to gain unauthorized access to user accounts
  • Use the platform to compete with our services
  • Provide false or misleading information

9. Intellectual Property

The Kilimolink platform, including its technology, algorithms, content, and trademarks, is owned by Kilimolink and protected by intellectual property laws. You may not copy, modify, or distribute our proprietary technology without written permission.

10. Limitation of Liability

To the maximum extent permitted by law, Kilimolink shall not be liable for:

  • Indirect, incidental, or consequential damages
  • Loss of profits, data, or business opportunities
  • Damages exceeding the amount paid for services in the past 12 months
  • Issues arising from force majeure events

11. Indemnification

You agree to indemnify and hold harmless Kilimolink from any claims, damages, or expenses arising from your use of the platform, violation of these Terms, or infringement of any third-party rights.

12. Termination

Either party may terminate this agreement with 30 days' notice. We may immediately suspend or terminate accounts for:

  • Violation of these Terms
  • Fraudulent or illegal activity
  • Repeated quality or delivery issues
  • Non-payment of fees

13. Governing Law

These Terms are governed by the laws of Kenya. Any disputes will be resolved through arbitration in Nairobi, Kenya, unless otherwise required by applicable law.

14. Changes to Terms

We may modify these Terms at any time. We will provide notice of material changes and your continued use of the platform constitutes acceptance of the modified Terms.
